MPU held the annual Suppliers Forum 2023

Medical procurement of Ukraine held the annual Suppliers Forum on the occasion of the beginning of the 2023 procurement cycle.

We familiarized suppliers with new procurement tools, innovations in relevant legislation, tender documentation, procurement procedures, anti-corruption policy, etc.

Edem Adamanov, acting general manager of the MPU, focused on the 2023 plans: "Temporarily, until July 3, open tenders with special features do not include an auction, so the participants of the procedures should submit a commercial offer with the final price. Also, we will not prolong delivery dates and will reject suppliers who have not kept obligations in 2022".

Another important innovation is the communication format with suppliers, noted Edem Adamanov: "MPU starts to implement the ERP system. Therefore, all communication with suppliers and preparation for tenders will occur in SAP Ariba system. After agreeing, the exchange of documents and management of the contract will occur in the supplier's cabinet in the MedData system".

Edem also encouraged suppliers to qualify for the medical part of the Prozorro Market electronic catalog: "The e-catalog is an important part of the public procurement reform. The assortment of the medical part of Prozorro Market is constantly expanding, so MPU will use this tool in 2023 for centralized procurement".

Maria Morozova, the head of the category management department, spoke about the areas for 2023 under centralized budget program 1400: "In 2023, MPU will purchase via 24 areas. We will use the following types of procedures: public tenders with unique features, procurement without using the Prozorro system in case of critical need, or if the procedure of public tenders with unique features did not take place, purchases via Prozorro Market and the SAP Ariba system for market consultations," explained Maria.

Serhii Omelianchuk, head of public procurement department, told about the features of the public tenders in 2023, the grounds for rejecting a participant's offer, and the disqualification of the supplier because of the results of the Due Diligence procedures.

He also provided recommendations for preparing and submitting a tender offer: "All documents submitted by the supplier must be valid and prepared in advance. Also, it is important to prepare a quality offer. There are 10 days to prepare the proposal and only 24 hours to correct errors".

Oleg Klots, the head of the logistics department of the MPU presented the changes in the logistics processes, in particular regarding the delivery period: "The MPU will determine the delivery period of products at the stage of announcing the procurement procedure based on the level of supply of relevant goods to the structural subdivisions for healthcare, subordinate institutions, and providers of medical services. The delivery period will not be prolonged at the motivated request of the supplier".

Oleksandr Fesenko, head of the legal support department, focused on changes in the relevant legislation: "The period of validity of registration certificates of the medicinal product acted until 04/01/2023 has been extended until the Law of Ukraine "On Medicinal Products" No. 2469-IX dated July 28, 2022, comes into force".

Oleksandr also discussed the basic requirements that suppliers must comply with in terms of anti-corruption and sanctions legislation: "The contract with the supplier can be terminated unilaterally in case of application of sanctions by the National Security Council, the UN Security Council, the European Union and other partner countries. Also, the contract can be terminated if the supplier does not notify the MPU about the change of the beneficial owner of the supplier within the 5 days from the date of such change".
