Managed Entry Agreements (MEA) is the new instrument in the field of healthcare procurement in Ukraine. They allow the procuring agency, following the order from the Ministry of Health of Ukraine, enter into the direct negotiations with the producers of the original and innovative medicines for their direct purchase.
Meaning, as soon as the innovative medicines appear on the world’s market, Ukraine will have a possibility to hold negotiations on their purchase directly from the producer.
Such instrument gives the following possibilities:
- for the patients - enlarge access to the innovative treatment for the affordable prices;
- for the state – to effectively use public funds, improve the access of the patients’ to the medicines, increase the level of patients’ treatment;
- for the producers/applicants – to receive the guarantees of the orders from the states in agreed quantities.
Such mechanism as MEA is used in numerous countries: the survey indicates that by 2019 MEAs were being or had been used in at least 28 of 41 countries that are members of the Organisation for Economic Co-operation and Development (OECD) and/or the European Union, such as the USA, Great Britain, France, Poland, Italy etc.
The Law of Ukraine № 531-ІХ dated 17 March 2020, initiated the establishment of the MEA into Ukrainian Legislation. However, the legislative work for the usage of the MEA still needs to be developed.
